Parent-Guardian Agreement for Minor Use

This Parental Consent, Payment Terms, and Terms of Service Agreement (the "Agreement") is entered into between the undersigned parent/guardian and GotIt App (the "Platform"), an online education platform providing tutoring services, operated by Raise the Bar LLP, with its principal place of business at Gurugram, Haryana. WHEREAS, the Parent/Guardian is the legal guardian of the minor, and is granting consent for the Minor's use of the Platform and associated services. NOW, THEREFORE, the parties agree as follows:

1. PARENTAL CONSENT AGREEMENT

1.1. Consent for Use: The Parent/Guardian grants consent for the Minor to access and use the Platform for educational purposes, including but not limited to text-based, audio, and video communication with tutors. 1.2. Data Collection and Privacy: The Parent/Guardian acknowledges that the Platform may collect and process the Minor's personal information as outlined in the Privacy Policy, and expressly consents to such processing. 1.3. Supervision: The Parent/Guardian agrees to supervise the Minor's usage of the Platform to ensure compliance with the Platform's guidelines and rules. 1.4. Withdrawal of Consent: The Parent/Guardian understands that they may withdraw consent at any time by contacting the Platform's support team to request account termination.

2. PAYMENT TERMS AGREEMENT

2.1. Financial Responsibility: The Parent/Guardian agrees to accept full financial responsibility for any charges, subscription fees, or one-time payments related to tutoring services availed by the Minor through the Platform. 2.2. Authorization of Charges: The Parent/Guardian authorizes the Platform to charge the provided payment method for any fees associated with the tutoring services. 2.3. Non-Refundable Payments: The Parent/Guardian acknowledges that all payments are non-refundable unless expressly stated in the Platform's Refund Policy. 2.4. Payment Information: The Parent/Guardian is responsible for ensuring that payment information is accurate and up to date. Failure to make timely payments may result in the suspension or termination of the Minor's access to the Platform.

3. TERMS OF SERVICE AGREEMENT

3.1. Platform's Role: The Parent/Guardian acknowledges that the Platform serves as an intermediary connecting students with tutors and does not directly provide educational content or tutoring services. 3.2. Compliance with Guidelines: The Parent/Guardian and the Minor must comply with the Platform's Terms of Service, which include guidelines for respectful communication, academic integrity, and appropriate use of the Platform. 3.3. Suspension of Access: The Platform reserves the right to suspend or terminate access if any violations of its policies are detected. 3.4. Changes to Terms: The Parent/Guardian understands that the Platform may update its Terms of Service from time to time and agrees to remain informed of such changes.

4. CHILD PROTECTION COMPLIANCE

4.1. Safety and Privacy: The Parent/Guardian acknowledges that the Platform is committed to protecting the safety and privacy of minors and complies with child protection laws, including but not limited to the Protection of Children from Sexual Offences (POCSO) Act, 2012. 4.2. Prohibition of Inappropriate Interactions: The Platform prohibits inappropriate interactions between tutors and minors. Any suspected violation of child protection laws will be reported to the relevant authorities. 4.3. Reporting Concerns: The Parent/Guardian agrees to report any concerns related to child safety on the Platform immediately to the support team. 4.4. Safety Measures: The Platform implements safety measures such as monitored communications, reporting mechanisms, and restricted tutor interactions to ensure compliance with child protection laws.

5. EDUCATION-SPECIFIC RULES

5.1. Tutor Qualifications: The Parent/Guardian understands that the Platform ensures its tutors meet the required qualifications and provide educational content that aligns with its internal educational policies and guidelines. 5.2. Content Review: The Platform reserves the right to remove any tutor or educational content that is found to be misleading, inappropriate, or non-compliant with educational policies. 5.3. No Guarantee of Effectiveness: The Parent/Guardian acknowledges that while the Platform takes reasonable efforts to verify tutor credentials, it does not guarantee the quality or effectiveness of tutoring services.

6. LIMITATION OF LIABILITY

6.1. Waiver of Claims: The Parent/Guardian agrees to waive any claims against the Platform arising from disputes between the Minor and the tutor, including but not limited to dissatisfaction with tutoring services, communication issues, or misunderstandings. 6.2. No Liability for Damages: The Platform is not responsible for any direct, indirect, incidental, or consequential damages arising from the use of its services. 6.3. Platform's Limited Role: The Parent/Guardian agrees that the Platform's role is limited to providing an online infrastructure for connecting students with tutors and does not bear responsibility for any actions or omissions of the tutors.

7. DISPUTE RESOLUTION MECHANISM

7.1. Mediation: The parties agree to first attempt to resolve any disputes through mediation facilitated by a neutral third party. 7.2. Arbitration: If mediation fails, the dispute will be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996. 7.3. Jurisdiction: If arbitration is not applicable, the courts of Delhi, India shall have exclusive jurisdiction over any disputes arising under this Agreement. 7.4. Exhaustion of Mechanisms: The Parent/Guardian agrees that they will not initiate legal action against the Platform until all dispute resolution mechanisms have been exhausted.

8. GENERAL PROVISIONS

8.1. Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements related to the subject matter. 8.2. Amendments: The Platform reserves the right to modify this Agreement, and continued use of the services by the Minor shall constitute acceptance of the revised terms. 8.3. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 8.4. Acknowledgment: By electronically accepting this Agreement, the Parent/Guardian acknowledges that they have read, understood, and agreed to the terms of this Agreement.
