TERMS AND CONDITIONS (T&C)

Welcome to GotIt Platform. These Terms and Conditions ("T&C") govern your use of our platform, services, and content as a learner, tutor, or visitor. By accessing or using our platform, you agree to be bound by these T&C. If you do not agree, please do not use our services.

2. Definitions

• Platform: The website/app providing educational services. • User: Any individual using the platform, including learners, tutors, or visitors. • Tutor: A qualified individual providing educational services on the platform. • Learner: Any individual receiving tutoring services. • Content: All materials, including text, images, videos, and learning resources, available on the platform. • Account: A registered user profile required to access certain features of the platform.

3. User Eligibility & Account Registration

3.1 Eligibility 1. Users must be at least 18 years old or have parental consent if younger. 2. Tutors must provide verified qualifications to offer services. 3. Users must not be previously banned from the platform. 3.2 Account Creation 1. Users must provide accurate personal details during registration. 2. Each user is allowed only one account; duplicate accounts may lead to suspension. 3. Users are responsible for maintaining account security. 3.3 Account Termination 1. The platform reserves the right to suspend or terminate accounts for: o Violating T&C o Engaging in fraud o Misconduct towards tutors, learners, or platform staff 2. Users can request account deletion by emailing [Support Email].

4. Platform Usage Rules

4.1 General Guidelines 1. Users must respect all members of the platform. 2. Use of the platform for illegal, fraudulent, or unauthorized activities is prohibited. 3. Users must not share, sell, or distribute any tutor's content without permission. 4.2 Prohibited Conduct 1. Harassment or abuse of any tutor, learner, or staff. 2. Cheating, plagiarism, or unethical conduct during tutoring sessions. 3. Hacking, spamming, or attempting unauthorized access to the platform. 4. Sharing personal details (contact, social media, etc.) for off-platform transactions. 4.3 Modifications & Service Availability 1. The platform reserves the right to modify services, pricing, or features at any time. 2. We do not guarantee 100% uptime, and services may be interrupted for maintenance.

5. Payment & Refund Policy

5.1 Payment Terms 1. Learners must pay in advance for tutoring sessions. 2. Tutors receive payments after successful session completion. 3. Payments are processed via secure payment gateways. 5.2 Refund Policy 1. Refunds are issued only under the following conditions: o Tutor cancels a session. o Learner cancels within the allowed timeframe ( 5 hours before session). 2. Non-refundable scenarios: o If a learner misses a session without notice. o If the learner is dissatisfied but attended the session.

6. Tutor Responsibilities & Obligations

1. Tutors must provide accurate and high-quality educational services. 2. Tutors must adhere to ethical teaching standards and avoid discrimination. 3. Tutors are responsible for maintaining confidentiality of student data. 4. Tutors cannot solicit learners for off-platform services. 5. Failure to meet obligations may result in account suspension or payment withholding.

7. Intellectual Property (IP) Rights

1. The platform owns all branding, website, and course materials. 2. Tutors own their original content but grant the platform a limited license to use it. 3. Users cannot: o Copy or distribute platform materials without permission. o Resell or repurpose tutor content. 4. Copyright violations may result in legal action.

8. Privacy & Data Protection

1. We collect and store user data only for service delivery and do not sell personal data. 2. The platform complies with GDPR and the Indian IT Act to protect user privacy. 3. Users can request data deletion via contactus@gotit.co.in.

9. Liability & Disclaimers

9.1 No Guarantees on Learning Outcomes • The platform does not guarantee specific academic results. • Tutors provide guidance, but learners are responsible for their progress. 9.2 Limited Liability • The platform is not responsible for: o Technical failures. o Miscommunication between tutors and learners. o Unauthorized use of accounts.

10. Dispute Resolution

10.1 Mediation Process 1. Users must attempt mediation through platform support before legal action. 2. Mediation will take place within 30 days of a dispute being raised. 10.2 Arbitration Clause 1. If mediation fails, disputes will be resolved by binding arbitration under Indian Arbitration Laws. 2. Arbitration costs will be shared equally unless ruled otherwise.

11. Modifications to Terms and Conditions

1. The platform reserves the right to update these T&C at any time. 2. Users will be notified of major changes via email. 3. Continued use of the platform constitutes acceptance of new terms.

12. Governing Law

• These T&C shall be governed by the laws of India.

13. Protection of Students and Tutors in Online Learning

13.1 Zero-Tolerance Policy on Harassment and Misconduct 1. Prohibited Behaviour: o Sexual harassment, inappropriate comments, or personal advances. o Asking for personal contact details or social media connections outside the platform. o Sharing offensive, obscene, or inappropriate material. o Any form of cyberbullying, discrimination, or threats. 2. Reporting Mechanism: o If a student or tutor experiences harassment, they can report it via email at contactus.gotit.co.in. o Reports will be investigated confidentially within 7 working days. o Users involved may be suspended or permanently banned based on evidence. 13.2 Laws Protecting Female Tutors and Students A. Information Technology (IT) Act, 2000 (India) • Section 66A: Punishes sending offensive, abusive, or threatening messages electronically. • Section 67: Prohibits publishing or transmitting obscene content online. • Section 72: Protects against unauthorized access to personal data. • Section 354D IPC: Criminalizes online stalking of female users. B. Protection of Children from Sexual Offences (POCSO) Act, 2012 • Applicable if students are minors (under 18 years old). • Any sexual comments, gestures, or exploitation over online tutoring platforms will be treated as an offense and reported to authorities. C. GDPR and Indian IT Rules (2021) • Platforms must protect students' and tutors' personal data. • Recording of sessions is allowed only with mutual consent. • No unauthorized sharing of images, videos, or personal information is permitted. 13.3 Secure Platform Policies 1. Session Monitoring: o The platform may allow recording of sessions for security purposes. o Recordings are encrypted and stored securely, accessible only in case of disputes. 2. In-App Communication Only: o Tutors and students must communicate only via the platform's secure chat/video call. o Any request to move discussions to personal WhatsApp, Telegram, or social media is prohibited. 3. Two-Factor Authentication (2FA): o Account login requires 2FA verification for tutors and learners to prevent impersonation. 4. Tutor Background Verification: o Tutors must provide government-issued ID proof and undergo screening checks before onboarding. 13.4 Consequences for Policy Violations 1. Minor Violation: Warning or temporary account suspension. 2. Severe Violation: Permanent ban, legal action, and reporting to authorities. 3. Legal Escalation: Cases of harassment, stalking, or abuse will be reported under Indian Penal Code (IPC) Sections 354, 509, and 66E IT Act. 13.5 Student & Tutor Safety Guidelines Do's Keep all communication within the platform. Report any inappropriate behaviour immediately. Ensure a parent/guardian is aware (for minors). Don'ts Share personal numbers, addresses, or social media accounts. Engage in any conversation beyond academic topics. Accept offline meeting requests. 13.6 Emergency Contact for Safety Issue contactus@gotit.co.in
